By accessing or using the up4 mobile application ("App") or website ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

up4 is a social coordination platform that allows users to:

  • Share their availability and interests with friends
  • See when friends are available for activities
  • Create and join real-time activities
  • Share location information with selected groups ("Circles")

3. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account and all activities that occur under your account.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, abuse, or harm other users
  • Share false or misleading information
  • Attempt to access other users' accounts
  • Use the Service to stalk or track individuals without consent
  • Interfere with or disrupt the Service or its infrastructure
  • Create multiple accounts for deceptive purposes

5. Location Sharing

Location sharing is a core feature of up4. You control who sees your location through Circles. We do not share your precise location with anyone outside your selected Circles without your explicit consent. You may disable location sharing at any time through the app settings or your device settings.

6. Content

You retain ownership of content you create on up4. By posting content, you grant us a non-exclusive, worldwide license to display and distribute that content within the Service for the purpose of operating and improving up4.

7. Intellectual Property

The Service, including its design, features, and content created by up4, is protected by copyright, trademark, and other laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Termination

We may suspend or terminate your account if you violate these terms or engage in conduct that we determine is harmful to other users or the Service. You may delete your account at any time through the app settings.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We are not responsible for activities or interactions between users that occur outside the app. We do not guarantee the accuracy of location data or user-provided information.

10. Limitation of Liability

To the maximum extent permitted by law, up4 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to personal injury, property damage, or loss of data.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
